These Terms constitute a legally binding agreement between you ("User", "you") and LumeraStack ("Company", "we", "us", "our"), the operator of LumeraStack.
We may update, revise, or replace these Terms at any time, at our sole discretion, without prior notice. Changes take effect immediately upon being posted to this page. The "Last updated" date at the top of this page will reflect when changes were made. Your continued use of the service after any change constitutes your acceptance of the new Terms. LumeraStack provides a digital business card platform that allows users to create, customise, and share digital profiles via NFC cards, QR codes, and unique profile links. The service includes:

Paid plans are billed as agreed at the time of purchase. Prices are subject to change at any time without prior notice.
ALL PAYMENTS ARE STRICTLY NON-REFUNDABLE. By completing a payment for any plan, NFC card, or service offered by LumeraStack, you expressly acknowledge and agree that no refunds, credits, chargebacks, or partial reimbursements will be issued under any circumstances — including but not limited to: change of mind, dissatisfaction with the service, account suspension or termination, service downtime, feature changes, or discontinuation of the platform. This no-refund policy applies to all subscription fees, one-time payments, NFC card orders, and any other charges.
NFC cards are physical products ordered separately via WhatsApp. Once an NFC card order is placed and payment is confirmed, it is final. We do not accept returns or exchanges on physical products. Delivery timelines are estimates only and LumeraStack is not liable for delays caused by couriers or customs.

You retain ownership of all content you upload to LumeraStack (profile photos, text, links, and other materials). By uploading content, you grant LumeraStack a worldwide, non-exclusive, royalty-free licence to store, display, and deliver that content as necessary to operate the service.
You are solely responsible for ensuring that any content you post does not infringe third-party intellectual property rights, violate privacy laws, or contain illegal material. We reserve the right to remove any content that violates these Terms without prior notice.
LumeraStack accepts no responsibility whatsoever for any personal data collected through the lead capture features. You — the card owner — are the sole data controller for all visitor data submitted to your profile. LumeraStack acts only as a data processor providing the technical infrastructure.
By using lead capture features, you accept full and exclusive legal responsibility for:
LumeraStack shall not be liable for any claims, fines, penalties, or damages arising from your collection, handling, or use of visitor data. If a regulatory authority or third party makes a claim against LumeraStack arising from your use of lead capture features, you agree to fully indemnify and hold LumeraStack harmless.
All images uploaded to LumeraStack are stored via Cloudinary, a third-party cloud media service. By uploading images, you confirm you have the right to use and share those images. We are not responsible for images that infringe third-party rights.
When you delete an image from your profile, it is also deleted from our cloud storage. However, CDN caching may mean the image remains temporarily accessible via direct URL for a short period.
You may delete your account at any time. Upon deletion, your public profile will be immediately deactivated. Your account data will be permanently deleted within 30 days, except where we are required to retain certain records by law.
We may suspend or terminate your account at any time if we determine you have violated these Terms, with or without notice. In cases of serious abuse, we reserve the right to permanently ban access to the platform.
The service is provided strictly "as is" and "as available" without any warranties, representations, or guarantees of any kind — express, implied, or statutory. LumeraStack makes no guarantee of uptime, availability, data retention, security, fitness for a particular purpose, or non-infringement. Use of the service is entirely at your own risk.
LumeraStack expressly disclaims all liability for:
To the maximum extent permitted by applicable law, LumeraStack shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, loss of data, loss of goodwill, business interruption, or cost of substitute services — even if LumeraStack has been advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the service shall not exceed the greater of: (a) the total amount you paid to LumeraStack in the 12 months immediately preceding the claim, or (b) LKR 5,000. If you have not paid us anything, our total liability is LKR 0.
All platform design, software, trademarks, logos, and branding associated with LumeraStack and LumeraStack are the exclusive property of LumeraStack. You may not copy, reproduce, modify, or create derivative works from our platform without express written permission.
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
